Foreign Bribery is a Crime
Bribery of a foreign public official has been a criminal offence in Australia since 17 December 1999. Bribery that occurred prior to this date may also be a criminal offence if any part of the offence took place in Australia. Bribery of a foreign private official has been a criminal offence in Australia since 17 December 1999. Reporting
The Australian Government advises that suspected incidents of foreign bribery be reported to the Australian Federal Police (AFP) located in the State/Territory in which the Australian company has its headquarters or the Australian national is resident. If you do not know this information, then submit your complaint to the AFP Operations Coordination Centre (AOCC) using the contacts below. Anonymous reporting is permitted. Those wishing to report anonymously should consider contacting Crime Stoppers (see below). Verbal and written reports can be accepted in English (official language). Supporting evidence can be translated. Those wishing to report in other languages should contact the translation service of the Department of Immigration and Citizenship (Telephone 131 450) where it is possible to report non-emergency crime. To call Australia from another country, use the international access code +61. Do not use the 0 in the area code. It is also possible to report information regarding suspected incidents of foreign bribery to the AFP Liaison Posts or the Australian embassy in the country where the bribery is alleged to have occurred. Australian public officials are required to report suspicions of foreign bribery to the Australian enforcement authorities.
Do
- Be aware that whilst anonymous reporting is permitted in Australia, the police will only investigate allegations of foreign bribery that are supported by sufficient evidence or testimony.
- Be aware that you may be required to give evidence in court relating to your knowledge of the facts.
- Indicate if the suspect(s) is aware of the allegation.
- Provide a chronological account of the information known about the suspected criminal activities.
- Provide a summary of any enquiries already undertaken.
- Provide an assessment of the significance or impact of the matter.
- Provide copies of any relevant documentation.
- Provide copies of any relevant legal advice sought and provided to you.
- Provide details of the suspected offender(s) (name, location, date of birth).
- State what action is being requested.

- Make a malicious report knowing that the report is incorrect.
